Asylum

Asylum is protection granted by a host country to a person who has fled persecution in his or her home country. The right to asylum is provided by international law (including the 1951 Convention relating to the Status of Refugees and its 1967 Protocol).

To qualify for asylum, you must show that you have suffered past persecution on one of five protected grounds: race, religion, nationality, political opinion, or membership in a particular social group. Generally, you must also have a well-founded fear of future persecution based on the same ground.

If you pass the credible fear or reasonable fear screening, an asylum officer will interview you. You can bring an interpreter and an attorney (if you have one). The interview can take from 1 hour to 4 hours, so be prepared. The decision to grant asylum is usually made within 180 days of the interview date. If the decision is denied, the case will be referred for deportation proceedings in immigration court.

Litigation

Litigation is the process of resolving disputes or asserting rights through the legal system. It can be time-consuming, costly and public. It is important to have an experienced lawyer by your side to guide you through the process.

The litigation process begins when a client approaches an attorney with a dispute or potential case. After a thorough discussion of the facts and evidence the client will be advised whether a legal case is feasible or not. If it is, an attorney will conduct a full investigation including research into the exact details of the matter and collect any relevant documentation or proof that can help the client.

Once this is complete the case will be ready for trial. During the trial both parties present their arguments to a judge or jury and a decision will be provided. If either party is dissatisfied with the verdict they may have the right to appeal the decision to a higher court.
